Supervisor William Zweng called the meeting to order at 7:30 p.m.

PRESENT:  Supervisor William Zweng, Trustee William Jenuwine, Treasurer Betty     Zweng, Trustee Sue Terhune, Clerk Violet Pfaff.

ABSENT:  None.

Also present:  Assessor Barbara Schutt, Township Attorney John McNamee.

 

AMENDMENTS TO THE AGENDA:

APPROVAL OF MINUTES:

 

Motion by Trustee Jenuwine to accept the meeting minutes for the following:

TREASURER’S REPORT:

 

Motion by Trustee Terhune to accept the Financial Report as presented for February by the Treasurer.  Supported by Trustee Jenuwine.  Vote on the motion:  Ayes:  All.  Nays:  None.  Absent:  None.  MOTION CARRIED.

APPROVAL OF CHECKS WRITTEN:

 

Motion by Treasurer Betty Zweng to accept the checks to be written for the end of March as follows:  Accounts payable:  Payroll checks in the amount of $20,186.23 and General Checks $17,797.55.  Supported by Trustee William Jenuwine.  Roll Call Vote:  Ayes:  Treasurer Zweng, Trustee Jenuwine, Trustee Terhune, Clerk Pfaff, Supervisor William Zweng.  Nays:  None.  Absent:  None.

7200 Marsh Road – Agreement was reached between the Attorneys.

 

OLD BUSINESS:

 

  1. Fire Run Reimbursement update by Clerk Pfaff.  HazMat spill 3/17 on Broadbridge Road, spill cost Road Commission  between $8,000 to $9,000.

 

2.   Blight Conditions/Unlicensed Vehicles

 

3.   Municipal Civil Infraction/MCL 125.538 through MCL 125.54:

     

Attorney John McNamee:  Enforcement under Dangerous Building Commission vs. Civil Infraction Ordinance.  Lengthy discussion followed.

 

      Motion by Trustee Jenuwine to pursue the Dangerous Building Ordinance.  Supported by Treasurer Betty Zweng.  Vote on the motion.  Ayes:  All.  Nays:  None.  Absent:  None.

4.      Proposal for Legal Services – Special Assessment:  discussion regarding bringing professional experts (i.e. Financial consultant, MTA Legal Guidance, Michigan Property Consultant, Attorney from Miller Canfield and Engineering) for their expert guidance in establishing a Water Ordinance which would include “Pay In Lieu Of” and “Side Yard Relief” clause.

 

Motion by Trustee Jenuwine to have Paul Stauder, Financial Advisor, Attorney John McNamee, Engineer David Lewandowski and Harold Boulger of Miller Canfield to work together in establishing a Water Assessment Ordinance for Cottrellville Township which would incorporate “Pay In Lieu Of” and “Side Yard Relief”.  Supported by Treasurer Betty Zweng.  Ayes:  All.  Nays:  None.  Absent:  None.

NEW BUSINESS:

 

1.      REACCEPTANCE OF MAYER ROAD FROM MARKEL ROAD TO ARNOLD ROAD 0.50 MILE

Supervisor Zweng:  Reconstruction of Mayer Road two years ago, Road Commission has reaccepted this road; all proper organizations have been notified. 

 

2.      IRA TOWNSHIIP – SHEA ROAD REQUEST TO EXTEND WATER LINES

     ON THE NORTH SIDE

           

    Motion by Trustee Terhune to provide Mr. Shawn Tetler the names in the water expertise field per his 15 February 2007 letter requesting a municipal water line being constructed on Shea Road from Starville Road to his property.  Supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

3.      REAPPOINTMENT PLANNING COMMISSION AND ZBA MEMBERS

 

Motion by Treasurer Betty Zweng to accept the recommendation from Supervisor William Zweng to reappoint the following Planning Commissioners for a three-year term:  Georgia Phelan, Debbie Hayes, Isla Boskee, Mary Agnes Simons, Bill Drake and George Kunnath.  Supported by Clerk Violet Pfaff.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

Motion by Treasurer Betty Zweng to approve the three-year reappointments to the Zoning Board of Appeals for the following:  Tom Raymond, term expires 5-01-07 and Pat Jenuwine, term expires 4-07-07.  Supported by Trustee Bill Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

4.      WATER FILLING STATION

 

Cost prohibitive to have a station in the township, Board in agreement not feasible.

 

       5.  2007/08 TWP. WIDE GARBAGE COLLECTION FEE $120.00 ANNUAL

 

Motion by Treasurer Betty Zweng to charge $120.00 per year to Cottrellville residents to be placed on the property tax bill as it was in the past to cover contract costs.  Supported by Trustee Terhune.  Ayes:  All.  Nays:  None.  Absent:  None.

6.  MUTUAL AID FOR EMERGENCIES APPROVAL

 

Mike Mulligan Representative has agreed to be the liaison between the St. Clair County County and the Township. 

 

Motion by Trustee Jenuwine to approve the Agreement for Mutual Aid for Emergencies and Disasters in St. Clair County and to authorize the Supervisor and the Clerk of the Township to sign.  Supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

      8.  BUDGET AMENDMENT

 

Engineering firm came in and did a survey of sewer and water system, recommended preventative type work be done to maintain the integrity of it, extra expense to the sewer system need to amend the budget by $70,000.

 

Motion by Treasurer Betty Zweng to amend the 2007-08 Sewer Budget by $70,000.  Supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

Motion by Trustee Terhune to set the Carroll Street 2007-08 Budget – Water $3,537.13 and Sewer - $3,673.60.  supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

9.       WATER PETITIONS

 

Water Petitions submitted for the following roads:  Broadbridge Rd. from Mayer Road over to the Parcel #016-2006-010;  McKinley Road from Parcel #017-2004-100 to Shea Road; Shea Road from McKinley Road  to Starville.

55.36% signed. 

 

Motion by Trustee Terhune to accept the water petitions and the Assessor to do certification.  Supported by Trustee Jenuwine.  R/C VOTE:  AYES:  Treasurer Betty Zweng, Trustee Terhune, Trustee Jenuwine, Clerk Pfaff, Supervisor William Zweng.  NAYS:  None.  Absent:  None.

10.  SURVEY – MUNICIPAL WATER

 

Discussed amendment to the Non-advisory Survey as stated by Clerk Pfaff.

 

Motion by Trustee Terhune to add a 3rd response (Already have Municipal Water) to the Survey.  Supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

Many public comments re: the necessity of the survey.

 

Motion by Trustee Terhune to not send the Non-Advisory Survey out at all.  Supported by Trustee Jenuwine.  Ayes:  All.  Nays:  None.  Absent:  None.

MOTION CARRIED.

 

COMMUNICATIONS:

 

Supervisor Zweng:  Any communications received this month are available from the Clerk’s Office.

 

April 27 and April 28th – Township wide road clean-up.

 

Food Give-A-Way will be held 11 April, 2007 – 12:00 – 200 p.m. – need volunteers.

 

Election School at the Township Hall on Friday, 13 April 2007.
