PLANNING COMMISSION
23 AUGUST, 2006 – REGULAR MEETING
1. Meeting called to order at 7:30 p.m. by Chairperson
Mary Agnes Simons.
2. Pledge of Allegiance.
3. Present: B. Pelc, D. Hayes, G. Kunnath, B. Jenuwine,
B. Drake.
Absent: G. Phelan, T. Raymond, I. Boskee.
Also present: D & T Construction
4. Approval of Minutes: No minutes since Ms. Phelan is
out of town.
5. Communications:
Acknowledged receipt of papers from D & T Construction,
Shelby Township. Vera Athanasosua, Civil Engineer representing
D & T Construction.
For the record the Planning Commission has received the
PUD application from D & T Construction for a project
named “The Villages of Golden Lakes.”
6. OLD BUSINESS: Continuing a review of the Ordinance:
Planner Richard Smith, Montgomery & Associates, Inc.:
Previously Mr. Drake mentioned the State law re: horse riding
stables and stable farms, have reviewed it, our language
regarding stables is more broadly focused, stable regulations
in the draft zoning ordinance is focused on stables used
to house other people’s horses, advise we stay with
the definitions we have.
B. Drake: Opposed stated reasons.
Consensus is to bring this back at the next meeting for
further discussion. Copies of State Law, Article 287.11
Act 93 provided by Mr. Smith to Commission members for review.
Decibels Levels – Debbie Hayes will continue her
research and report back to the Board.
Chairperson Simons suggested set the public hearing for
D & T Construction before we continue with discussion
re: Ordinance review.
7. NEW BUSINESS:
Cottrellville Township Planning Commission will hold a
Public Hearing for D & T Construction, Shelby Township
for a project named “The Villages of Golden Lakes”
on Tuesday, October 24, 2006 at Cherry Beach Senior Center,
7:00 p.m.
General Provisions:
Section 132.1403; B. remove the words “intentionally
abandoned”, read as follows: No Class B nonconforming
use shall be resumed if it has been discontinued for a continuous
period of at least twelve (12) months,……”
Continue with Ordinance Review – Page 28, Article
132.1330 “Open Air Display and Sales of Homeowner’s
Gardening Equipment, Lawn and Yard Supplies and Products,
Seasonal or Holiday Products, or Other open-Air Display
of Miscellaneous Products”: purpose is to provide
some base regulations for these kind of uses, may not come
up too often, i.e. Xmas Tree sales on a separate lot from
the farm, idea is there be a review of what is proposed
before the Planning Commission. Lengthy discussion regarding
a hard surface base on storage spaces. Phase “engineered
gravel service” was preferred by the Board.
Review the General Business Districts and regulations re:
storage areas, buffering, parking & loading areas, caretaker’s
residents, etc.
Bill Drake: Under the caretaker residence need to stipulate
“if there is a caretaker manager/residence must reside
there or employee of the business.”
Questioned the statement re: “No explosive hazardous
or radioactive material shall be stored on the premises……..”
how will we manage or monitor this? Discussion followed.
Motels, hotels, other facilities with accommodations: Commission
questioned #2 re: limitation of stays in motel. Discussion
followed. Planner Richard Smith will revisit this section
and if need to address this some other way will bring it
back.
Fast Foods (B-2 District): Regulations reviewed. Change
to the “no speaker system allowed” statement.
Questioned many fast food services now are joined with a
gas station (mixed use facility). All special land use would
require a site plan review.
Motor Vehicle and Repair Service Facility: All activity
inside the building, set-back, no outside junk storage,
no outdoor parking of junk vehicles, etc. Questioned limitation
of 72 hrs. parking of damaged vehicles, feel it should be
at least 7 days allowed. All in agreement. Language re:
Tow truck parking.
Motor Vehicle Washing Facilities: Regulations reviewed.
Bill Drake objected to the 400’ requirement, excessive
footage. Discussion followed.
Motorized Vehicle Racetracks including auto, go-carts and
cycle: Regulations reviewed.
Go Carts move to recreational area, require a special land
use in the B-2 District.
Junk Yards: Industrial district, subject to additional
local licensing requirements by separate ordinances. Fence
height should be a minimum of 10’ and not 8’
high.
Bill Jenuwine: Questioned #1: site should not abut an area
zoned for nonresidential purposes. Add the 100’ minimum
from residential.
Minimum/maximum lot size suggested in the ordinance. Bonding
required for restoration, clean up of the property. Tires
need to deal with this uniquely and separately. Inspection
made by the local fire department.
Planner Richard Smith: Reminder with these special land
uses need to be concerned with the reasonable protections
of the land, the operations of the business are things we
have to stay away from in terms of the zoning, want to address
the operations really need a separate regulatory ordinance.
Bond for the protection of the people in the surrounding
areas.
Green pages were received tonight; consensus of the Commission
is time to review the material.
Planner Richard Smith stated also included is the Planned
Unit Residential Development.
Pointed out inconsistency on page 2279, (2) compared to
page 2281, last paragraph changes the final authority over
the project. Length discussion followed.
Adjournment:
Motion by Drake, supported by Kunnath to close the regular
meeting.
